SMS Sender Terms & Conditions

Pornographic, offensive, racist, hate, discriminatory, defamatory or copyrighted material is not permitted to be sent using the SMS Sender Module.
You acknowledge that Xara Online delivers SMS messages via various mobile network carriers around the world and cannot therefore guarantee delivery of an SMS message. Xara Online makes every effort to deliver the message promptly, but cannot accept any liability for transmission delays or message failures.
This service is provided 'as is' and messages sent are at the sender's own risk.
The service shall not be used for SPAM or sending unsolicited messages to any mobile or cell phone. Any member found responsible for sending unsolicited messages will have their account terminated and may be liable for damages and costs.
Because worldwide access to the various network operators is constantly changing Xara Online reserve the right to alter the service, alter prices or remove access to certain mobile operators or countries, and to do this with no notice if necessary.
Xara Online shall provide no refunds for unused SMS message credits.
You are responsible for maintaining your own username and password and must take any appropriate measures, such as regularly changing your password, to prevent unauthorized access to your account. Xara Online are not responsible for misuse or unauthorised use of your account.

In no event shall Xara Online or any approved Reseller be liable for any direct, indirect, special, incidental or consequential damages, including but not limited to loss of data or profit, arising out of or in connection with the use or performance of this service, even if Xara Online or a Xara Online authorized representative shall have been advised of the possibility of such, and whether based in an action in contract, or any other theory of liability.
